After the matter of heard at some length, it is agreed between Counsel that the appeal can be disposed in terms of the following order. It is ordered, accordingly, as follows :

(i) Paragraph-14 of the impugned order dated 13 April 2015, shall be substituted by the following paragraph:

903. COAPP 70-15.doc "14. For the reasons discussed herein above, the voting rights in respect of the disputed 9850 shares, shall be suspended pending the hearing and final disposal of this appeal."

(ii) In view of disposal of the Appeal, the Company Application does not survive, and the same is also disposed of.

(iii) The Court is informed that the National Company Law Tribunal has fixed the main appeal on 5 January 2017. It is hoped that the Tribunal disposes of the appeal as expeditiously as possible after taking up it on 5 January 2017.
