Commercial Appeal (L.) No.41 of 2017 was heard on merits. On 19.07.2017, at the request of the parties, the Appeal was adjourned for today, as some workable proposals before commencement of the arbitration were to be discussed and settled in between the parties.

Without prejudice to the rights and contentions of both the parties i.e. the Appellant and the contesting Respondents have submitted consent minutes of order today before us in Notice of Motion (L) No. 27 of 2017. They pray that the Appeal alongwith Notice of Motion be disposed of in terms of the said Minutes of Order dated 21.07.2017. The learned counsel appearing for the parties submits that the Consent Minutes of Order dated 21.07.2017 runs into four pages, contains 12 paragraphs and each page is signed by the respective learned counsel for the parties. The said Consent Minutes of Order is taken on record and marked "X" for identification. The disclosure statement as per section 12(1) of the Arbitration and Conciliation Act, 1996 is also placed on record and marked as "XX" for identification. 2/3

The counsel appearing for the parties submit that they have agreed for appointment of arbitrator and Mr. Gaurav Joshi, Senior Advocate is appointed as arbitrator. The Appeal alongwith the Notice of Motion is disposed of in terms of the Consent Minutes of Order marked "X.. Order accordingly.
