Mr Narichania on instructions seeks leave to withdraw the Notice of Motion. I have previously noted that there is a separate proceeding filed by ICICI Bank in the District Court at Surat (now transferred to Baroda). All rights and contentions of both sides are left open for decision in those proceedings. I make it clear that I have not addressed any of the issues raised on merits in this Notice of Motion.
