The learned Counsel for the respondents raise a preliminary objection to the tenability of the writ petition on the ground that the petitioner has an alternate remedy of challenging the "otherwise termination". It is stated that instead of availing the alternate remedy of challenging the so called termination before the Tribunal, the petitioner has rushed to this Court.

Since we were inclined to uphold the preliminary objection, the learned Counsel for the petitioner, on instructions, seeks permission to 1 / 2

wp.1672.2014_3.doc withdraw the writ petition. The learned Counsel states that the points raised in this petition would be agitated before the Tribunal. Permission to withdraw the writ petition is granted. Writ petition is disposed of as withdrawn. All the points raised in this petition are kept open.
