CORAM : Smt. Vasanti A Naik & Riyaz I. Chagla, JJ.

DATE : 1st November, 2017.

P.C. :

By this writ petition the petitioner seeks a direction against the respondent authorities to give police protection to the petitioner to enable him to carry out the repairs to his gala-shop. According to the petitioner, some repairs are required to be carried out in the gala-shop of the petitioner but some neighboring occupants are threating the petitioner of dire consequences if the petitioner carries out the repairs. According to the petitioner, the petitioner had made representations in the years 2013 and 2014 but the respondents have failed to provide the police protection to the petitioner.

Sudhir Rane 36-WP-2083-2017.doc We are not inclined to grant the relief prayed by the petitioner in the instant petition. Some threats were allegedly given to the petitioner in the year 2012, 2013 and 2014. Representation were made by the petitioner to the respondent authorities in the years 2013 and 2014. The writ petition is filed in the year 2017. The respondent authorities have already replied to the petitioner that the dispute between the petitioner and the other persons, that are not joined to this petition as party respondents, is of a civil nature and if so desired the petitioner may take appropriate proceedings against them. Instead of filing appropriate proceedings for seeking injunction against the said persons, the petitioner has filed the instant petition. In the circumstances of the case, we are not inclined to grant the relief prayed by the petitioner. Hence, the writ petition is dismissed with no order as to the costs.
