The appeal relates to A.Y. 2009-10.

The tax effect involved in the present appeal is only to the tune of Rs.11,10,349/-. It is submitted that even in respect of the assessment of the husband of the present respondent, the Revenue has not filed the appeal. It appears that they were the joint owners of the property.

Moreover, as the tax effect is less than Rs.20 lakhs, the learned Uday S. Jagtap

The appeal is disposed of as withdraw. It is made clear that the legal issue involved is kept open. No costs. 5.

The Court Fees as per Rules, be refunded.
