Admittedly, learned counsel for the petitioners states that the only prayer that he has sought in the petition is to decide the eligibility of 489 slum dwellers. Mr. J. Rais, learned senior Advocate appearing for the MCGM states that the eligibility of 289 slum dwellers taken up for consideration out of which only 250 slum dwellers came before the authority to establish their eligibility and out of the said 250 slum dwellers, only 91 were held to be eligible. In view thereof, the petition has become infructous. In the event, the

20. os wp 2880-18.doc petitioners seek to challenge the orders of determining eligibility, the same may be done through an independent proceedings. Petition is disposed of.
