By an order dated 1st April, 2022, this Court had passed direction for the plaintiff to file an affidavit in lieu of Examinationin-Chief, failing which the evidence of the plaintiff would stand closed. Thereafter, the matter came up on 6th June, 2023, 8th June, 2023 and 12th June, 2023 on which date, this Court placed the matter on 26th June, 2023 for dismissal. The matter however, could not be taken up on account of paucity of time on 26th June, 2023, 27th June, 2023 and 28th June, 2023 and was placed for dismissal today.
