The petitioner died on 17th July, 1999 and the Chamber Summons has been taken on 3rd May, 2010. Hence the Chamber Summons is within limitation. In view of the averments made in paragraph Nos.1 and 2 of the affidavit, the Chamber Summons deserves to be made absolute in terms of prayer clause (a).
