The Petition is under Section 29-A of the Arbitration and Conciliation Act 1996. The Respondent is absent though served. He was non-cooperative in the arbitration before the learned sole arbitrator Mr Anupam J Dholakia, retired District Judge. The reference to arbitration was by an order of 1st February 2017. The arbitration proceeded and an extension was granted on 3rd December 2018 for a period of six months. The extended arbitral mandate ended on 2nd June 2019. This Petition was filed immediately thereafter but has been pending since. 2.

The delay in listing of Petition is not attributable to the Advocates for the Petitioner.

My attention is invited to page 87 which shows that before the learned sole arbitrator, hearings are complete and what remains is filing of written notes of arguments and then the passing of an award.

Accordingly, I will extend time till 30th April 2020. 5.

The Arbitration Petition is disposed of in these terms. No costs.
