Learned counsel appearing for the judgment creditor invited my attention to the affidavit of service dated 14th February, 2017 which indicates that the insolvency notice is published in the newspaper 'Free Press Journal' in English and also 'Navshakti' in Marathi on 28th January,2017. None appeared for the judgment debtor. The notice is based on an ex-parte decree obtained by the judgment creditor against the judgment debtor in Summary Suit No.1525 of 2013 filed against the judgment creditor in the City Civil Court, Bombay which has not been impugned by the judgment debtor. The notice is accordingly made absolute. No order as to costs.
