This is an application is by one of the executors of the Will dated 29th September 1999 of one Banoo Rustom Baxter who died in Mumbai on 24th July 2004. The present executor is one of three named in the Will. He wishes to renounce executorship on account of his age and failing health. He is unable to attend his duties as an executor.

The Petition is made absolute in terms of prayer clause (a). The Petitioner is discharged as an executor of the last Will and Testament dated 29th September 1999 of the late Banoo Rustom Baxter.
