Mr. Samdani, the learned Senior Counsel appearing for the Petitioner having taken instructions from his client makes a statement that in the light of guidelines dated 21st October 2016 issued by the Ministry of Defence, Government of India, the BMC has issued part commencement certificate. In that view of the matter, Mr. Samdani, seeks leave to withdraw the writ petition with liberty to file fresh one, if need arises. Leave with liberty as prayed for is granted. Petition is allowed to be withdrawn and is dismissed as such.
