This Chamber Summons is taken out to bring the legal representatives of defendant Cynthia Allams who passed away during the pendency of the suit. The defendant passed away on 19th February, 2018. The application is supported by the copy of the death certifcate. The application seems to be within the statutory period of limitation.

Mr. Denzil D.Mello, the learned counsel submits that he has instructions to appear on behalf of the proposed legal representative of the deceased/defendant and the proposed legal heirs have no objection to implead them as defendant Nos. 1A to 1E. 3.

In view of the above statement, the Chamber Summons is made absolute in terms of the prayer clause (a). Vishal Parekar, P.A.

Necessary amendment be carried out in accordance with the schedule of amendment to Chamber Summons within a period of one week.

The copy of the amended plaint be served on the newly impleaded defendant Nos. 1A to 1E.

Defendant Nos. 1A to 1E may fle written statement appropriate to their character as the legal representative of the deceased defendant, within a period of four weeks of being served with the plaint.
