After the matter is heard at some length, it is agreed between learned Counsel for both parties that the impugned award passed by a sole arbitrator in the present case may be set aside, by consent, to the extent the award relates to claim Nos.3, 4, 5, 6 and 9. Accordingly, the award is set aside to the extent of these five claims and the reference is remitted for a fresh hearing in accordance with law. Mr. R.V. Govilkar, Advocate, is appointed as an arbitrator to hear the matter afresh in accordance with law. The learned arbitrator shall endeavor to dispose of the reference as expeditiously as possible and preferably within six months from entering upon the reference.
