Learned counsel submits that the issue has been examined and he has received instructions to withdraw the Appeal to file the same in the High Court of Telangana. He states that this Court, in the case of Pr. Commissioner of Income Tax-3, Pune vs. M/s. Sungard Solutions (I) Pvt. Ltd. (Income Tax Appeal No. 1142 of 2016) in identical circumstances has returned the papers of the appeal to the Appellant - Revenue to file the same in the appropriate Court. 1/2
