NOTICE OF MOTION NO.259 OF 2016 Have considered the affidavit in support of the notice of motion and additional affidavit in support filed by the advocate on record for the petitioner affirmed on 24th January, 2017. For reasons mentioned therein, the notice of motion lodging no.162 of 2016 and notice of motion lodging no.163 of 2016 are restored to file.
This notice of motion accordingly stands disposed. NOTICE OF MOTION (L) NO.162 OF 2016 AND NOTICE OF MOTION (L) NO.163 OF 2016 Have considered the affidavits in support. For reasons mentioned therein, both the notices of motion are allowed and accordingly Gauri Gaekwad
2/2 NMT-259-2016.doc disposed. Testamentary Petition No.474 of 2011 is restored to file. Mr. Patil, counsel for the petitioner undertakes to remove all office objections and get the notices of motion numbered on or before 4th February, 2017. Mr. Patil further states that the so called health ground of the advocate on record for the petitioner will not come in the way of removing office objections.
It is made clear that if the office objections are not removed by 4th February, 2017, the notices of motion will stand dismissed without further reference to the court.
