The Chamber Summons seeks condonation of delay of 203 days in filing affidavit in support of the caveat. Another legal heir and next of the kin of the deceased has already filed a caveat and accordingly the petition has already been converted into a testamentary suit. In the premises, the delay in filing affidavit in support of the caveat is condoned and the Applicant is permitted to file her affidavit in support of the caveat. Learned Counsel for the Applicant tenders his affidavit in support of the caveat. The same is taken on record.
