NOTICE OF MOTION NO.1120 OF 2015 Mr. Munshi, counsel for plaintiff, on instructions seeks leave to withdraw the notice of motion.

Notice of motion is dismissed as withdrawn. In view thereof, the question of framing issue under Section 9A of the Code of Civil Procedure, 1908 does not arise.

Therefore, whichever defendant has not filed written statement should file the written statement and serve a copy thereof upon the plaintiff on or before 10th June, 2017.
