There was an ad-interim order dated 17th June 2016. This was an order after Notice to the Defendant No.1. Service has since been effected on Defendants Nos. 1 and 3 as well. An Affidavit of Service dated 17th June 2016 is on file. A further Affidavit of Service on Defendant No.3 will be filed in the course of the week. 25th July 2016

Despite service, there is no Affidavit in Reply nor are the Defendants represented.

For the reasons set out in the ad-interim order dated 17th June 2016, that order is confirmed as the final order on the Notice of Motion as against Defendant Nos.1 and 3. In addition, and for the same reasons, there will also be an order in terms of prayer clause (b) of the Notice of Motion.

The entire Notice of Motion is disposed of in these terms, with costs, and with liberty to the Plaintiffs to apply afresh for the same or other reliefs against Defendant No.2 after service. In addition, the Plaintiffs will be entitled to apply, at the stage of final disposal of the suit, for an order and decree against all the Defendants for actual costs incurred on this Notice of Motion.
