Ms.S.I.Shah for the Registrar of Companies/respondent. ---- CORAM : K.R.SHRIRAM,J DATE : 12.1.2016 P.C.:- The company petition is taken out by the director of the petitioner company under Section 560 (6) of the Companies Act 1956 (the said Act) seeking directions against the Registrar of companies for restoration of the name of the petitioner i.e., Makhani Hotels & Restaurants Private Limited to the register of companies which was struck off by a Notification published in part III- section 1 of the Gazette Notification issued by Government of India for the period October-14 to October-20, 2006.

Considering the averments made in the petition, the petition is allowed in terms of prayer clause-(a) on the following terms and conditions :- (a) The Directors of the company will obtain Director's identification numbers and file all statutory returns

including pending statutory returns and compliances electronically under the various provisions of the Companies Act with the Registrar of companies within a period of 12 weeks from the date of this order ; (b) The petitioner-company shall comply with section 266A to 266G, 159 to 162, 166, 210 & 220 of the Companies Act 1956 and 153 to 158, 92 to 96 and 137 of Companies Act 2013 and also compound the offences by making appropriate application under Section 621A of the said Act ;

(c) The petitioner company shall also pay cost of Rs.15,000/- to the respondent within four weeks from today.

The petition accordingly stands disposed.
