It appears from the averments made in the petition and from the annexures to the petition that for the same relief, the petitioner has already filed original application before the Central Administrative Tribunal. The averments made in the petition make it clear that as ad-interim relief was not granted by the Tribunal and as Division Bench of Tribunal was not available that the present petition has been filed.
