After the matter was argued for some time, both counsel, on instructions from their respective clients, who are present in court, state that they are ready and willing to go for arbitration and the disputes under the document, which is annexed at Exhibit 'C' to the petition (the said document), be referred to sole arbitration by Mr. Justice S.N. Variava (retired), Former Judge of Supreme Court of India. Therefore, Mr. Justice S.N. Variava (retired), Former Judge of Supreme Court of India, is appointed as the sole Arbitrator to decide on all issues between the parties arising out of or relating to or connected with the said document. All rights and contentions of both the parties are kept open. It will be open for petitioner to file an application under Gauri Gaekwad
