CORAM : B. P. COLABAWALLA, J.

AUGUST 9, 2019.

P.C. :

After these Notice of Motions were argued for considerable amount of time, both the parties have agreed that no reasons be given for the present order. This is for the simple reason that elaborate reasons have already been given by this Court at the ad-interim stage on 10th July, 2014 in Notice of Motion No.2128 of 2015 [Notice of Motion (L) No. 1496 of 2014]. The ad-interim order passed by this Court on 10th July, 2014 in terms of prayer clauses (a) Pg 1 of 3

to (c) of Notice of Motion No. 2128 of 2015 shall continue till the hearing and final disposal of the suit. The prayer clauses (a) to (c) of Notice of Motion No. 2128 of 2015 reads thus - "(a) That pending the hearing and disposal of the above suit, this Hon'ble Court be pleased to stay the effect and operation of the impugned ex-parte decision dated 14th June, 2014; (b) that pending the hearing and disposal of the above suit, this Hon'ble Court be pleased to issue a temporary order and injunction restraining Defendant Nos. 1, 5 and 6 from acting in pursuance of and/or giving effect to the ex-parte decision dated 14th June, 2014;

(c) that this Hon'ble Court be pleased to issue a temporary order and injunction restraining defendant Nos.1,2,5, 6 and 7 by themselves, their servants, their affiliated associations and agents and assigns from issuing any other Non- Cooperation Directive against the Plaintiffs in violation of this Hon'ble Court's order dated 23rd October, 2012."

Both the Notice of Motions are disposed of in the aforesaid terms. However, in the facts and circumstances of the case, there shall be no order as to costs.

The learned advocate appearing on behalf of defendant No.1 states that defendant No.1 shall file its Written Statement within a period of eight weeks from today. The said statement is accepted. Pg 2 of 3

All other defendants also are directed to file their Written Statements within a period of eight weeks from today.

Place the suit on board "For Directions" on to 27th September, 2019.
