Learned counsel appearing for the petitioner tenders an affidavit of the petitioner dated 9th February 2016 of which the petitioner has annexed a copy of Deed of Settlement dated 26th December 2016 between the petitioner and the respondent on the terms and conditions mentioned in the Deed of Settlement. It is submitted that in view of the Deed of Settlement arrived at between the parties, the petitioner seeks liberty to withdraw this company petition.
