(i) The order 30 th November, 2016 passed by the Central Government Industrial Tribunal No.2, Mumbai is set aside. (ii)The Presiding Officer, Central Government Industrial Tribunal No.2, Mumbai shall hear the Reference No.CGIT-2/75 of 2009 afresh and an Award shall be passed within a period of four weeks from the date of this order. (iii)In the event of the Presiding Officer, Central Government Industrial Tribunal No.2, Mumbai not being available, the Reference No.CGIT-2/75 of 2009 shall be heard by the Presiding Officer, Central Government Industrial Tribunal No.1.
