This Notice of Motion is pending. The applicant-plaintiff does not appear to have made any application in this notice of motion. There is nothing on record to indicate even service of the motion. In any event, the motion seeks securing of claim in the suit and disclosure of assets and for subsequent issuance of warrant of attachment.

In view of the fact that no interim or ad-interim orders have been applied or passed and the suit is now to proceed ex-parte, no purpose would be served by keeping this motion pending. The motion is therefore disposed being infructuous.

In the circumstances, time to file affidavit-of-evidence of the remaining witnesses shall stand extended till 3 rd March 2022.
