In the facts of the case, we are of the view that parties may raise appropriate issue in the Notice of Motion which is to be heard by the learned Single Judge. 4.

It is clarified that we have not expressed any opinion on merits of the matter.

Needless to mention that if the parties move the learned Single Judge for expeditious hearing, the learned Single Judge would decide the Notice of Motion without being influenced by the observations made in the impugned order. 6.
