This matter was heard in the morning session. 2.
Ms. Shastri learned Additional Government Pleader, on our suggestion, has taken instructions from the Department of Law and Judiciary, Government of Maharashtra.

The matter was called out in the afternoon session in order to enable Ms. Shastri to report the outcome of her discussion with the concerned officials. On second call, Ms. Shastri would submit that the State withdraws the communication dated 12th August, 2013, copy of J.V.Salunke,PS
903-WP.2711.2014.doc which is at page 48 of the paper book. It means, the Chief Metropolitan Magistrate, Mumbai need not abide by the directions contained in this communication from the Department of Law and Judiciary, Government of Maharashtra. Once this communication by the State is withdrawn, it is needless to clarify that the office order dated 29th November, 2013, copy of which is at pages 49-50 of the paper book, stands withdrawn.

As a result of the above, no recoveries can be made from the concerned employees, including the petitioners. 5.
In the light of the above, the writ petition does not survive and stands disposed of as such.
