For the reasons mentioned in the affidavit in support, the suit stands restored. Notice of motion accordingly stands disposed. On 5th February 2019, the Prothonotary and Senior Master, High Court, Bombay, had passed an order directing the written statement to be filed on or before 4th March 2019, failing which, the suit will be transferred to undefended suits. No written statement has been filed. Therefore, the suit be transferred to list of undefended suits and list it before the appropriate court.
