Having perused the averments made in the petition and more particularly the averments made in paragraph 7 of the petition, the mandate of the arbitral tribunal to conclude the arbitral proceedings stands extended for a further period of 10 months from today. There shall not be any further extension, as the arbitral proceedings had commenced from November, 2017 and it is already about 5 years. The extension without an objection to limitation needs to be granted considering the pandemic period and as per the orders passed by the Supreme Court in the proceedings of Suo Motu Writ Petition (Civil) No. (s) 3/2020 in the case of Re: Cognizance for Extension of Limitation1 and also followed by this Court in ICATCH Communications India Ltd. vs. The Divisional Manager/Authorized Personnel & Anr. in Arbitration Petition (L) No. 381 of 2020 3.
