This notice of motion is taken out by the Respondents for recall of an ex-parte order passed in the arbitration petition. The arbitration petition was filed under Section 9 of the Arbitration and Conciliation Act, 1996. The petition was allowed and Court Receiver was appointed in respect of the property which is the subject matter of present petition. That was on 20 June 2011. Learned Counsel for the Applicants (original Respondents) submits that her clients do not press the notice of motion, since the matter has since been settled between the parties and outstanding dues of the original Petitioner have been paid. Notice of motion is disposed of as not pressed. No order as to costs. Pg 1 of 2

In view of the disposal of the arbitration petition, the receiver appointed in the matter shall stand vacated without passing any accounts. The Court Receiver's costs, charges and expenses shall be paid by the Petitioner within three weeks of the receiver communicating the same.
