By this petition filed under section 2 of the Bombay Regulation Act, VIII of 1827, the applicant who is son of the deceased late Mr.Shamrao Ganpat Madane seeks issuance of the legal heirship certificate in respect of the said deceased who died on 1st April, 2015. A copy of the death certificate is annexed. It is stated in the petition that the said deceased died intestate. The names of the legal heirs and next-of-kin are disclosed in paragraph (4) of the petition. It is stated that save and except the legal heirs mentioned in paragraph (4) of the petition, there are no other legal heirs or next-of-kin left by the deceased. The parents of the deceased are predeceased to the deceased. The deceased had no other son or daughter except mentioned in paragraph (4) of the petition.

The petitioner has filed consent affidavits of all the legal heirs other than, the petitioner which are annexed at Exs. C to J. Except Mrs.Swati Krushnad Jadhav who is married daughter and who is staying at Satara, rest of the legal heirs are present in court who are identified by the learned cousnel appearing for the petitioner.

The statements made in the petition are accepted. In this circumstances, proclamation is dispensed with. Petition is accordingly made absolute in terms of prayer clause (a). No order as to costs.
