CORAM :- S. C. DHARMADHIKARI & B. P. COLABAWALLA, JJ.
DATED :- AUGUST 26, 2016 P.C. :- 1) After the matter was argued for sometime, the petitioners' advocate seeks leave to withdraw the writ petition, but the only apprehension while so withdrawing it and expressed before us is that this withdrawal would be construed as having given up the claim during the proceedings under the Trade Marks Act, 1999. 2) While we allow the withdrawal of the writ petition, as desired by the petitioners, we clarify that this withdrawal shall not be construed as waiving or giving up any of the rights or contentions in such proceedings as may have been pending or may be initiated under the Trade Marks Act, 1999. 1-WP.1959.2014.doc 3) The writ petition is dismissed as withdrawn with clarification as above. In the light of the withdrawal of the writ petition, the chamber summons does not survive and stands disposed of as such.
