Perused the Report dated 22-04-2016. The Court Receiver has submitted that through oversight the Registry had accepted royalty from Defendant No.6/agent of the Court Receiver, for the period 2000 to 2003, though pursuant to the order dated 18-08-2000 passed by this Court, the Court Receiver stood discharged in respect of the suit property and he was directed to pay over to the Plaintiff an amount of royalty lying deposited in the Office of the Court Receiver upto 18-08-2000. In view thereof, a Notice was given to Defendant No.6. In response, Mr. Ashwin Doshi, Director of the Company has appeared before the Court and has informed the Court that Defendant No.6 is now in liquidation and he is appointed as the Liquidator of the Company with all the powers under Section 512(1)(a) and other provisions of the ssp 1/2
crr 201 of 2016 (904).sxw Companies Act, 1956. The Court Receiver is therefore, directed to hand over residual amount of Rs.4,49,655.55 to Mr. Ashwin Doshi, who is appointed as Liquidator of the Defendant No.6 Company.
