CORAM :- S. C. DHARMADHIKARI & G. S. PATEL, JJ.

DATED :- FEBRUARY 25, 2016 P.C. :- 1) On the earlier occasion, we had, after hearing both sides on 17th December, 2015, passed an order. That order essentially gives the Petitioner an opportunity to deposit a sum as indicated in para 2(a) of that order and within a period specified. 2) We had given enough time, namely, six weeks to deposit this amount. Mr. Kanetkar told us in the morning session that this amount is not deposited.

912-WP.1575.2015.doc 3) This statement is not disputed by the Petitioner's Counsel. We cannot keep on extending any benefits of the nature claimed by the Petitioner for, that would mean the bank's dues will remain outstanding permanently. The bank must be allowed to take recourse to law. In these circumstances, there is no merit in the Writ Petition. It is dismissed.
