Mr. Suresh Kumar files an affidavit of one Jagdish-Principal Commissioner of Income Tax, Central-4, Mumbai affirmed on 6.5.2022 which is taken on record.

Mr. Suresh Kumar also tenders compilation of documents which are taken on record.

After petition was heard for some time, Mr. Suresh Kumar on instructions from Mr. Sumit Ahuja, DCIT(C)8(1) and Mr. Rohit R Ghodke, DCIT (Judl) to PR.CIT (Central-4) stated that the Court may quash and set aside order dated 19.4.2021 which is impugned in this petition and remand the matter for denovo consideration.

Mr. Pardiwala states that petitioner's submissions are already on record but still for good order's sake, fresh submissions based on the show cause notice, copy whereof is at Exhibit Y to the petition will be filed with concerned authorities within 2 weeks from today. The concerned authority shall consider those submissions and dispose petitioner' s application under 'Direct Tax Vivad Se Vishwas Act, 2020' within 6 weeks thereafter, following principles of natural justice and in accordance with law.
