The present petition alongwith the notice of motion for condonation of delay, is pending since the year 2018 before this Court. The impugned arbitral award was passed as far back as on 29th May, 2018. The petition was filed in this Court in November, 2018 and since then, it has not been listed even once before this Court.

It was only upon a specific direction given by this Court, for listing such matters filed and kept pending, that this petition alongwith the notice of motion, has seen the light of the day. 3.

Even today, when the petition and the notice of motion, are called out for hearing, none has appeared on behalf of the applicant / petitioner.

Hence, list under the caption 'for dismissal' on 12th April, 2023."

As noted hereinabove, even today, there is no appearance on behalf of the applicant / petitioner.

Hence, the petition along with the notice of motion is dismissed for non-prosecution.
