In view of the categorical statement made by the learned Counsel for Respondent No.2 to the effect that the port handling and coastal transportation of Bulk/Break-bulk cargo and loaded and empty containers between Kandla (KICT) - New Mangalore Port/Cochin/Tuticorin (coastal freight) to and fro will not require the vessel to stop at any of the port in Maharashtra, the learned Counsel for Petitioners submits that the objection about the territorial jurisdiction of Yadav VG 1/2

904.wpl.1944.18.odt this Court to entertain this Petition raised by the Respondent No.2 appears to be correct. In the circumstances, he seeks leave to withdraw the Writ Petition with liberty to the Petitioners to file a fresh Petition before the appropriate forum.

Writ Petition is disposed of with above liberty. 4.
