By consent of parties, the impugned award, being the subject matter of challenge in the present petition, is set aside. The Chemical and Alkali Merchants' Association shall now refer the matter to any arbitral tribunal on its panel after following the appointment procedure prescribed in its bye laws. After an arbitrator is appointed, the arbitrator shall expeditiously hear the reference and dispose of the same within a period of four months from his appointment. The arbitrator shall immediately after his appointment fix the matter with notice to both parties for preliminary directions, declare a time bound schedule for filing the statement of claim, written statement and presentation of evidence - oral or documentary.

The arbitrator shall give notice to both the parties of every date of hearing of the arbitration reference, unless such notice is waived by either of parties. It is also made clear that whenever any pleadings or documents are filed by either of parties before the arbitrator, a copy thereof shall be duly served on the other side.
