There are two groups of matters listed before us. Sr. Nos. 1 to 72 are said to be pending matters. Sr. Nos. 73 to 232 are disposed of matters.

The entire group is assigned to us by an administrative order of the Hon'ble the Chief Justice for a limited purpose of issuing appropriate directions to submit filings.

The short background is that all these 231 matters were filed during the lockdown at various times from March or April 2020 onward. They were all filed in soft copy by email. No physical filings have been done in any of these matters. At present, the Registry does not have either a physical record or even a digital record. This is because all of these matters were only sent in by email. For some reason, these emailed filings have not been docketed or retained by the Registry. This is almost certainly because the filings sent by email were being dealt with by the courts or benches after downloading the emails. There was no centralized repository.
Further, the roster/assignment during the lockdown was not as per a regular roster: benches were sitting on only some days for some period of time, and the work distribution did not have the structured system to which we are otherwise used to having. Sometimes, the same matter was sent by email more than once, depending on which bench was taking it up. On account of online storage constraints and limitations, some emails were deleted to make space. The backups, when there were backups, were entirely unsorted and were simply dumps of emails and attachments.

At the time of filing by email during the lockdown, all these matters were originally assigned a temporary filing number in the 'LD-VC' format. This was not synched or coordinated with the regular filing series. The Registry has since then reconciled the LDVC numbering series of these email-filed numbers and assigned
formal lodging or stamp numbers. There is thus now a CIS record of all these matters with a lodging number but as yet no physical or digital record at all of the matter itself.

This is a serious problem. The issue is not about the numbering but about this Court having its record complete in physical or soft copy form (or both) in regard to all these matters. This being a 'Court of Record', it is required to preserve copies of all matters that are before it. This will be required for both pending and disposed of matters. For pending cases, the issue is even more serious, simply because without a physical (or even digital) record, it is not possible to list these matters in future for any purpose at all. 6.
We are not to make any order on merits. That is not the purpose of having these matters assigned to us. Indeed, some of these matters pertain to the roster or assignment of Single Judges or other Division Benches. Further, one of these matters cannot be taken up by one of us (Mr Justice Madhav J Jamdar) for any decision on merits. Today's order is, therefore, for a limited purpose of filing directions and nothing else.

As regards the group of 'pending matters' from Sr. Nos. 1 to 72:
(a) Advocates for the Plaintiffs or the Petitioners in all these matters are required to file a physical copy of the original pleading, all Interim Applications as also all Affidavits in Reply or Rejoinders that may have been exchanged by email.
(b) Along with the physical files a soft copy in PDF form is to be submitted on a pen drive.
(c) This is to be done by 25th March 2022.
(d) The Registry may on its own extend time by no more than two weeks for compliance until 8th April 2022. (e) For those matters until there is no compliance, i.e. where there is no physical filing or the physical filing is incomplete, these matters will be listed on 11th April 2022 before us for directions.
(f) Where any matters in this group are wrongly shown as pending, but have actually been disposed of, the separate directions below for disposed-of LD-VC matters will apply.

For the second group from Sr. Nos. 73 to 23, being maters disposed of during the lockdown, for completeness of record- (a) Only soft copies in PDF form are required to be filed by the Advocates for the Plaintiff/Petitioners/Applicants by 1st April 2022.
(b) If there is non-compliance with these directions in respect of any of these already disposed of matters, these matters will also be listed for further directions on 11th April 2022.

Where physical filings have already been done, and the matters are therefore wrongly listed in either of these groups, the requirement of a soft copy on a pen-drive is dispensed with. For
such matters, advocates for the Petitioners must inform Ms Rajshree Kale, Additional Prothonotary & Senior Master, by praecipe and will attend the Registry for physical verification on such date as Ms Kale sets for this purpose.

Further, given the extraordinary situation, we permit the Advocates for the Petitioners/Plaintiffs/parties to complete the filing by submitting their pleadings or filings notarized as of the current date for compliance with these directions. Evidently, Petitioners and Plaintiffs cannot notarize copies of affidavits of the other side or opponent. The filings of the opposite party should be submitted as received by email. Further directions will follow. 11.
