After arguing for some time, the learned counsel for the Petitioner seeks leave to withdraw the Petition with liberty to the Petitioner to file Revision Application before the State Government challenging the impugned order passed by the Commissioner. 2.

With the aforesaid liberty to file Revision under Section 10(A)(3) of the Bombay Entertainment Duty Act, 1923, we allow the Petitioner to withdraw the Petition.

In case the Revision Application as aforesaid is filed within 30 days from today, the same shall not be dismissed by the said authority on the ground of limitation.

All contentions are kept open.

The Petition is disposed of as such.
