It is correctly pointed out that the Defendant has failed to comply with the conditional order dated 17th July 1998 passed by the Appeal Court. The Appeal itself against the decree was withdrawn by the Defendant on 14th June 1999. It seems that no notice was given to the Decree Holder but the reason given for withdrawal was that the matter had been settled out of Court. This is incorrect, as the Decree Holder is moving even now in execution and he is fully at liberty to do so.

For the present, however, the Court Receiver stands discharged without passing accounts.
