This Petition has been filed seeking leave under Clause XII of the Letters Patent. The Suit is for recovery of monies under an Indemnity-cum-Declaration which has been executed in Bandra (West), Mumbai. The Defendants are residing at Panvel. Accordingly, I am satisfied that, a material part of the cause of action having arisen within the jurisdiction of this Court, with leave granted under Clause XII of the Letters Patent, this Court will have the jurisdiction to entertain and try the proposed Suit. 2.
