Perused the Report. The Report is allowed in terms of prayer clauses (a) and (b), which are reproduced hereunder :

"(a)The Court Receiver may be discharged without passing accounts and Plaintiff Bank may be directed to deposit cost, charges and expenses of the Court Receiver as per provisional statement of account within the time stipulated by this Hon'ble Court upon taking inspection; (b)Cost of this Report may pleased be awarded in the sum of Rs.3,000/- (Rupees Three Thousand only) and the Plaintiff Bank may be directed to deposit the same in the Office of the Court Receiver; 2.

The learned Advocate for the Plaintiff undertakes to pay the amounts set out in prayer clauses (a) and (b) above to the Court Receiver within a period of one week from today. The undertaking is accepted. The Report is accordingly disposed of. ( S.J.KATHAWALLA, J. ) ssp 1/1
