I have heard Mr.Chavan and have perused the consent affidavit of the daughter of the petitioner in support of the Judge's Order. The petitioner had offered justifying surety in the nature of fixed deposit receipt in the sum of Rs.25,00,000/- before this Court since one of the beneficiary Ms.Nishani Kirtikumar Doshi was minor at that point of time. The said Ms.Nishani Kirtikumar Doshi has now attained the age of majority and has filed a consent affidavit dated 18th April, 2017 giving no objection for discharging of the surety. 2.
Learned Prothonotary & Senior Master is accordingly directed to return the said fixed deposit receipt in the sum of Rs.25,00,000/- submitted by the petitioner as justifiable surety 1/2
7-jot55-17 pursuant to an order dated 28th February, 2015 passed by the learned Additional Prothonotary & Senior Master. It is however, made clear that the petitioner shall produce the proof of payment of Rs.25,00,000/- within one week from the date of payment to the said Ms.Nishani Kirtikumar Doshi before the Prothonotary and Senior Master.
