Perused the order of this Court (Coram : R.D. Dhanuka, J.) dated 24th April, 2013, whereby Mr. Justice R.J. Kochar (Retired) was appointed as an Arbitrator to decide the disputes between the parties. The learned Advocates appearing for the parties have informed the Court that Mr. Justice R.J. Kochar (Retired) is unable to act as Arbitrator and therefore this Court may appoint any retired Judge of this Court as an Arbitrator in place of Mr. Justice R.J. Kochar (Retired).

In view thereof, Justice Dr. S. Radhakrishnan (Retired) is appointed as a sole Arbitrator to decide the disputes between the parties. The rest of directions given in the order dated 24th April, 2013 shall continue to remain in force. The above Petition is accordingly disposed of. (S.J. KATHAWALLA, J.)
