Dr. Tulzapurkar tenders an Affidavit dated 12th July 2016 of one Dhruv Vaid in compliance with the previous order. There is also a report dated 14th July 2016 submitted by Mr. Darshan Bandiwadekar, Software Programmer, High Court, Appellate Side, Bombay, as also a site report dated 12th July 2016 by the Court Receiver.

Mr. Bhagat appears for the Defendant. He states that Mr. Hitesh Surana of the Defendant is personally present in Court. He instructs Mr. Bhagat to say that the Defendant submits to a decree in terms of prayer clause (a). As regards the infringing goods that have been seized and sealed, it is agreed that these will be delivered to the Plaintiffs. The Plaintiffs will be at liberty to dispose them off in such manner as the Plaintiff thinks fit.

In view of this, Dr. Tulzapurkar does not press his claim for damages. The Suit is decreed in terms of prayer (a). Drawn up decree dispensed with. Refund of Court Fees, if any, in accordance with the Rules.

The Court Receiver stands discharged without passing accounts, but upon Plaintiffs paying costs, charges and expenses. 5.

Notice of Motion (L) No.1898 of 2016 does not survive and is disposed of as infructuous.
