2] In Chamber Summons, there is a prayer for condonation of delay of 23 days in preferring the appeal. In normal course, the applicant/appellant ought to have filed a Notice of Motion for condonation of delay. However, we find that this is a case of technical delay inasmuch as the appeal has been admitted by the Division Bench of this Court by order dated 20th June 2018 after hearing the respondent as well as the secured creditors and interim relief has been granted. Hence, Chamber Summons is made absolute in terms of prayer clause (a). 3] Time to remove the office objection is extended by a period of three weeks from today.
