In view of the Affidavit filed by the Respondent No. 3TransUnion CIBIL Limited, it is now an admitted position before the Court that the Petitioner is not a willful defaulter. The Petitioner would therefore be eligible under the Production Linked Incentive (PLI) Scheme for promotion of domestic manufacturing of critical Key Starting Materials (KSMs) / Drug Intermediaries and Active Pharmaceutical Ingredients (API) 2.

In the circumstances, the Respondent No. 2 shall now AKN 1/2

2/2 12.WP.615.2021.doc proceed on the basis that the Petitioner is eligible under the aforesaid scheme and the Petitioner shall be entitled to make investment and furnish Bank Guarantee and avail the incentive / subsidy under the said scheme. The Respondent No. 2 shall take appropriate steps accordingly at the earliest. 3.
